A design patent is a way to protect your intellectual property (IP) rights with regard to the shape and/or appearance of an entire article, or an ornamentation applied to an article.

• Examples of the shape/appearance of an article could include: the shape/appearance of a bottle; a piece of furniture; a smartphone display and shape; or a piece of jewelry.
• Examples of ornamentation applied to an article could be decoration or distinctive markings drawn /painted /adhered upon an article.
• A number of requirements must be fulfilled to receive a design patent. However perhaps the most important requirement is good drawings.
• In the US—as opposed to many other countries—a design patent application almost always includes quality black-and-white line drawings showing at least 3-4 views of the article. Generally, photographs are not sufficient.
